Paternity Suit

What You Need To Know About A Paternity Suit.

Often a paternity suit arises because one party denies fathering the child. Out of embarrassment or an unwillingness on the part of the man to support the child, a paternity suit is initiated to force the issue. It is then necessary to prove in the courts through a paternity suit that the child is indeed the man's child. Through the legal 'chain of evidence' there must be a neutral party present to validate the results of a blood test to determine the true parents of the child. Therefore, in order for the paternity suit to have any chance of success this test must be done in a laboratory or places which the court approves as legitimate. This means the home DNA test might solve the problem before it goes to court, but will not be acceptable in court proceedings.

It is necessary to prove beyond a doubt the father of the child. If child support is necessary, unless the identity of the father is proven, no child support can be assessed. In all too many cases the man wants to shun his financial responsibility to the child and the only way to force him to contribute to the child is through a paternity suit. The woman sometimes tries to entrap a man not responsible for producing the child and brings an unwarranted paternity suit. It is embarrassing to be charged with something you did not do and end up as a party in a paternity suit.

Lawyers who are familiar with family law will be required to handle the claims of both parties to the paternity suit. Family court is usually the venue for the paternity suit. Once the identity of the child is established the court will take action to resolve the case. In the case of complicated adoptions the court can initiate a paternity suit.
